Terms of Sale
These terms cover how we quote, supply and ship instruments. They apply alongside anything separately agreed in writing for your order.
1.This website is not a shop
Nothing on this site is an offer to sell at a stated price, and no order is placed through it. Prices are given by quotation only.
Adding items to an enquiry list and sending it to us is a request for a quotation. A contract exists only once we have issued a proforma invoice and you have confirmed it.
2.Quotations and prices
Quotations are valid for 30 days unless we state otherwise, and are based on the quantities, patterns, finishes and packaging described in them. Changing any of those may change the price.
Unless stated otherwise, prices are ex-works Sialkot and exclude freight, insurance, duties and any taxes payable in the destination country.
3.Minimum order and quantities
Our standard minimum is 50 pieces per line. We may agree a smaller trial order for a first shipment.
For custom manufactured items, we may deliver and invoice within 5 percent of the ordered quantity. Anything outside that we will agree with you first.
4.Samples
Samples are supplied so you can check pattern, finish and quality before committing to a production order. Samples are representative; small variations between a sample and a production batch are normal in hand-finished instruments.
Samples ship free for confirmed distributor enquiries. Freight on samples is normally at your cost.
5.Payment
Payment terms are set out on the proforma invoice. For new customers this is normally an advance deposit with the balance before shipment.
Bank charges at your end are your responsibility. We begin production once cleared funds are received against the deposit.
6.Lead times and delivery
Lead times quoted are estimates made in good faith from the date the order is confirmed and payment received. We will tell you promptly if a date is going to move.
We are not liable for delays outside our control, including transport, customs clearance, strikes or events of force majeure.
7.Inspection and claims
Please inspect goods on arrival. Claims for shortage, damage in transit or instruments not matching the order must reach us in writing within 14 days of delivery, with photographs.
Where a claim is accepted we will, at our option, replace the instruments or credit them. Instruments must not be returned without our agreement.
8.Warranty and intended use
We warrant that instruments are free from defects in material and workmanship when they leave us. The warranty does not cover normal wear, blunting through use, damage from incorrect sterilisation or cleaning agents, misuse, or modification.
Instruments must be cleaned, sterilised and used according to accepted clinical practice and any instructions supplied. It is the buyer's responsibility to ensure the instruments are registered, labelled and approved as required in the destination country before they are placed on that market.
9.Private label and intellectual property
Where you supply artwork, marking or drawings, you confirm you have the right to use them, and you accept responsibility for any third-party claim arising from our use of them on your order.
Tooling we create at your cost for your exclusive patterns remains identified to your account. Our own designs, catalogue photography and reference numbers remain ours.
10.Liability
Our liability in connection with any order is limited to the invoice value of the goods concerned. We are not liable for indirect or consequential loss, including loss of profit or loss of contracts.
Nothing in these terms limits liability where the law does not allow it to be limited.
11.Governing law
These terms are governed by the law of Pakistan, and the courts of Sialkot have jurisdiction, unless we agree otherwise in writing for your order.
